Your Information. Your Rights. Our Responsibilities.

This notice describes how your medical information may be used and disclosed by ClearCardio LLC, and how you can access this information. It is provided in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and the Texas Medical Privacy Act (Texas Health & Safety Code, Chapter 181). Please review it carefully.

Your Rights

When it comes to your health information, you have certain rights under HIPAA andTexas law. You have the right to:

● Get a copy of your medical record (electronic or paper)

● Request corrections to your record if it is incorrect or incomplete

● Request confidential communication, such as being contacted only at a certain phone number or address

● Request limits on how your information is used or shared for treatment, payment, or healthcare operations

● Get a list (accounting) of those with whom we’ve shared your information

● Get a copy of this privacy notice at any time

● Designate someone to act for you if you have given them medical power of attorney or they are your legal guardian

● File a complaint without fear of retaliation if you believe your privacy rights have been violated

These rights are guaranteed under 45 C.F.R. §§ 164.502, 164.524–528 and Texas Health & Safety Code §§ 181.102, 241.153


Your Choices Regarding How We Share Information

In certain situations, you have the right to decide how we share your health information. If you have a clear preference, please inform us. We will follow your instructions to the extent allowed by law.

You may choose whether or not we:

● Share your information with family members, close friends, or others involved in your care

● Share your information with organizations involved in disaster relief efforts

● Include your information in any patient directory (if applicable)

If you are unable to communicate your preferences—for example, if you are unconscious—we may share your information if, in our professional judgment, doing so is in your best interest. We may also share your information when necessary to prevent a serious and imminent threat to your health or safety or the health and safety of others. (Tex. Health & Safety Code § 181.154(c); 45 C.F.R. § 164.510)


We will not share your information in the following circumstances without your explicit written authorization:

● For marketing purposes, including communications that encourage you to purchase or use a product or service

● For the sale of your health information to a third party

● For most disclosures of psychotherapy notes, as defined by HIPAA

Our Typical Uses and Disclosures

We may use or share your health information in the following ways, as permitted by law:


Treatment


To provide you with medical care and coordinate services with other healthcare providers involved in your care.


Payment


ClearCardio may use your health information to collect payment for services rendered. This includes sharing information as needed with billing processors, collection services, or authorized third-party payers (such as a health savings account administrator, employer, or legal representative).


Please note: ClearCardio does not submit claims to insurance companies. While we do not handle insurance billing, we may provide you with appropriate documentation so that you can submit claims directly to your insurance provider, if desired.


Your information may be used to:

● Confirm the services you received

● Generate invoices or receipts

● Pursue payment directly from you or a third party on your behalf

These activities are permissible under HIPAA (45 C.F.R. § 164.506) and Texas Health & Safety Code § 181.154(b) as part of healthcare operations and financial administration.


Healthcare Operations


To manage ClearCardio’s internal operations, such as quality improvement, staff training, and business management. (45 C.F.R. § 164.506; Texas Health & Safety Code § 181.154(b))

Other Permitted or Required Disclosures


We may also share your information:

● For public health and safety (e.g., disease prevention, product recalls, abuse reporting)

● With health oversight agencies and law enforcement, when required

● For organ donation and with medical examiners or funeral directors


● For workers’ compensation, military, or national security purposes

● To comply with court orders or legal actions (Tex. Health & Safety Code § 181.153; Tex. Occ. Code § 159.004; 45 C.F.R. § 164.512)

We will only release this information with your explicit written authorization unless required by law.

Authorization Requirements and Limitations

As defined in Texas Health & Safety Code § 181.001 and 45 C.F.R. § 164.508, ClearCardio must obtain a signed authorization from you or your legally authorized representative before disclosing your protected health information electronically, unless the disclosure is for treatment, payment, healthcare operations, or otherwise permitted by law.

You may revoke any authorization at any time in writing, except when disclosures have already occurred in reliance on that authorization.

Fees for Records

You have the right to access your records. In accordance with Texas Health & Safety Code § 241.154 and 45 C.F.R. § 164.524(c)(4), a reasonable, cost-based fee may apply for processing, retrieving, or copying your health records.

Our Responsibilities

ClearCardio is required by law to:

● Maintain the privacy and security of your protected health information

● Provide you with this Notice of Privacy Practices

● Notify you in the event of a breach of your information

● Follow the terms of this notice and not share your information without your consent unless the law allows it

● Ensure compliance with all applicable provisions of HIPAA, the Texas Medical Privacy Act, and other state regulations
