1. Acceptance of these terms
These Terms of Use ("Terms") are a binding agreement between you and ClearCardio® LLC ("ClearCardio," "we," "us," or "our"), located at 4343 N Josey Ln, Carrollton, TX 75010, governing your access to and use of this website and the tools and content available on it. By accessing or using the Site, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
These Terms govern the website only. Enrollment in our medical programs, clinical evaluations, and treatment are governed by separate written patient agreements, consents, and disclosures provided during intake — not by this document. Nothing on this website constitutes such an agreement.
2. Definitions
In these Terms:
- "Site" means the websites operated by ClearCardio at clearcardio.com and its language variants, including all pages, forms, quizzes, and embedded tools.
- "Content" means all text, graphics, images, video, audio, data, page layouts, designs, and other material displayed on or delivered through the Site.
- "Assessment tools" means interactive educational features on the Site, such as the Pulse Score, that generate general informational summaries from your self-reported answers.
- "Services" means the preventive cardiology programs and clinical services ClearCardio offers, which are engaged only through separate written patient agreements.
- "You" means the individual accessing or using the Site.
3. Eligibility
The Site is intended for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to submit information through the Site, use its assessment tools, or request our Services. By using the Site, you represent that you meet this requirement and that any information you submit is accurate and truthful. We do not knowingly collect information from minors; see our Privacy Policy for how we handle such information if we discover it.
4. Nature of this website — not medical advice
All Content on the Site is provided for general educational and informational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the professional judgment of a qualified clinician who has personally evaluated you. Health information changes rapidly, applies differently to different people, and can never account for your individual circumstances through a website.
Never disregard professional medical advice, or delay seeking it, because of something you read on this Site. Reading our Content, watching our videos, or using our assessment tools does not make you a patient and creates no doctor–patient relationship (see Section 5).
If you think you may be having a medical emergency — including chest pain, pressure, shortness of breath, or symptoms of a heart attack or stroke — call 911 or go to the nearest emergency room immediately. Do not use this website, its forms, or its scheduling tools to seek emergency care; they are not monitored for urgent clinical issues.
Educational Content on the Site — including podcast episodes, videos, and articles — may reflect the views of individual clinicians or guests at the time of recording or publication. Such views are those of the speakers, may not reflect the current state of the evidence, and are not statements about your care. Discussion of any medication, test, or intervention is general information only: decisions about starting, stopping, or changing any medication belong exclusively to you and your treating physician.
5. Medical services and the doctor–patient relationship
Using this Site, submitting a form, completing an assessment tool, booking an introductory call, or receiving educational material from us does not create a doctor–patient relationship and does not enroll you in any ClearCardio program. A doctor–patient relationship with ClearCardio is established only after formal intake, clinical evaluation by one of our physicians, mutual acceptance into a program, and execution of the separate written patient agreements and informed consents we provide at that stage.
Those patient agreements — not these Terms — govern the clinical relationship, including the scope of services, program terms, fees, scheduling, refund and cancellation provisions, and each party's clinical rights and responsibilities. Where anything on this Site appears to conflict with a signed patient agreement, the signed agreement controls. Descriptions of our programs on the Site are informational summaries, not binding offers, and program availability and details may change.
6. Direct-pay practice, fees, and payment terms
ClearCardio is a direct-pay medical practice. We do not participate in insurance networks and do not submit claims to insurance companies on your behalf. On request, we can provide documentation (such as an itemized receipt or superbill) that you may choose to submit to your own insurer; whether any reimbursement is available is solely between you and your insurer, and we make no representation about it.
All fees for our Services are disclosed to you before you schedule or commit to paid care, and are set out in the written patient agreement you sign at enrollment. Prices shown on the Site, if any, are informational and subject to change until confirmed in a signed agreement. Fees may be payable by the methods we specify, and eligible medical services may be payable with HSA or FSA funds where applicable — confirm eligibility with your plan administrator; we do not provide tax or benefits advice.
Refunds, cancellations, and rescheduling for clinical Services are governed exclusively by the terms of your signed patient agreement. Nothing on this Site creates a right to a refund, and no statement on the Site constitutes a promise of individual medical outcomes. Every patient is different, and individual results vary.
If we accept payments through the Site or through links from it, payments are processed by third-party payment processors under their own security standards; we do not store your full card number on our systems. All amounts are stated in U.S. dollars, and you are responsible for any taxes that apply to your purchase under applicable law. If a payment is declined or subsequently unwound (for example, by a chargeback that is not the result of our error), any related scheduling may be paused until payment is resolved.
7. Booking, forms, and communications consent
When you submit a form or book a call through the Site, you agree to provide accurate, current contact information about yourself, and you consent to ClearCardio contacting you by phone, email, and text message (including messages sent with automated technology) regarding your inquiry, scheduling, and related follow-up. Consent to receive text messages is not a condition of receiving care or purchasing any service; message and data rates may apply, and you may opt out of texts at any time by replying STOP (HELP for help) and of marketing emails via the unsubscribe link in any message.
Website forms are for contact and scheduling purposes only. Do not use them to send medical information — symptoms, diagnoses, medications, test results, or other health details. They are not monitored by clinicians, are not part of your medical record, and are not designed to receive protected health information. Clinical communication takes place exclusively through our secure patient portal once you are a patient.
You agree that we may communicate with you electronically, and that electronic communications — including email, text messages, and notices posted on the Site — satisfy any legal requirement that a communication be in writing. If you provide an electronic signature or click an acceptance button on the Site, it has the same force and effect as a handwritten signature to the extent permitted by law.
8. Assessment tools — Pulse Score
The Site offers interactive educational tools, including the Pulse Score, that generate a general informational summary based on the answers you choose to provide. "Pulse Score" is a brand name for this educational tool; despite the word "score," it is not a medical or validated clinical risk score, does not measure, grade, or rate your actual heart health, and produces no numeric diagnosis or risk rating. These tools are for education and engagement only. They do not perform a medical evaluation, do not calculate a validated clinical risk score, do not diagnose any condition, and do not recommend or provide treatment. Their output is general information about categories of cardiovascular risk factors — it is not personalized medical advice and must not be relied on to make health decisions.
Summaries may be generated in part with automated (including AI-assisted) software and may contain errors or omissions. Only an evaluation by a qualified clinician — including appropriate testing — can assess your actual cardiovascular status. If any tool output concerns you, discuss it with a physician; if you have urgent symptoms, call 911. Your answers are handled as described in our Privacy Policy.
9. Intellectual property and limited license
The Site and all Content — including the ClearCardio® name and marks, logos, text, graphics, page designs, videos, and the structure and presentation of our educational material — are the property of ClearCardio® LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site and to view, download, and print Content for your personal, non-commercial use only, provided you keep all copyright and proprietary notices intact. Except as allowed by that license or by law, no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, distributed, sold, or transmitted in any form without our prior written permission. Nothing on the Site grants any license to use the ClearCardio® name or marks. All rights not expressly granted are reserved.
Copyright complaints. We respect the intellectual-property rights of others and respond to notices that comply with the Digital Millennium Copyright Act (DMCA). If you believe material on the Site infringes your copyright, send a written notice to care@clearcardio.com or to our mailing address that includes: identification of the copyrighted work and of the allegedly infringing material and its location on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove or disable access to the identified material and, where appropriate, notify the person who posted it.
10. Acceptable use
You agree to use the Site only for lawful purposes. Without limiting that obligation, you agree NOT to:
- Attempt to gain unauthorized access to the Site, its servers, or any connected system, or probe, scan, or test their vulnerability;
- Interfere with the Site's operation, including by transmitting malware, launching denial-of-service attacks, or imposing an unreasonable load on our infrastructure;
- Scrape, crawl, harvest, screen-grab, or systematically extract Content or data from the Site, whether manually or with automated tools, except as permitted by a published robots directive;
- Submit false, misleading, or impersonating information through forms or tools, or submit information about another person without their authorization;
- Use the Site to transmit unsolicited commercial communications, or to post or transmit unlawful, defamatory, obscene, or infringing material;
- Decompile, disassemble, or otherwise attempt to derive the source code of any software component of the Site;
- Use the Site or its Content to train, fine-tune, or ground machine-learning models for commercial purposes without our written permission.
We may investigate violations, restrict or terminate access, and involve law enforcement where appropriate (see Section 16).
11. User submissions, reviews, and testimonials
If you voluntarily submit a review, testimonial, comment, or other material to us — directly, through the Site, or through a third-party review platform that authorizes our use — you grant ClearCardio a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit for length or clarity (without changing meaning), publish, and display that material, with your first name and city/state, in our marketing and on the Site. We will not publish your full name, photograph, or any health details beyond what you yourself chose to share without your separate written permission, and any use of patient-specific health information in marketing requires your written HIPAA authorization, which you may revoke as described in our HIPAA Notice of Privacy Practices.
You represent that any material you submit is your own genuine experience and does not infringe anyone's rights. Testimonials reflect the individual experiences of specific patients; they are not a promise that you will achieve the same outcome, and individual results vary. We are under no obligation to publish any submission, and we may remove user material at our discretion.
12. Third-party services and links
The Site links to and embeds services operated by third parties — including our appointment-booking calendar, the patient portal at portal.akutehealth.com, YouTube video embeds, Trustpilot reviews, and podcast platforms. Those services are governed by their own terms and privacy policies, which apply as soon as you interact with them. We do not control third-party services, are not responsible for their content, accuracy, availability, or practices, and provide links solely for your convenience. A link does not imply our endorsement of a third party or its content.
13. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Medical and scientific information evolves; while we work to keep Content current and accurate, we make no warranty as to its completeness or currency. This section does not limit any warranty or duty owed to enrolled patients under a signed patient agreement or under applicable medical-practice law, and some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARCARDIO® LLC AND ITS OFFICERS, PHYSICIANS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF USE, OR LOSS OF PROFITS — ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE SAME EXTENT, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITATIONS APPLY TO THE WEBSITE ONLY: NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, AND NOTHING IN THESE TERMS LIMITS OUR RESPONSIBILITIES TO ENROLLED PATIENTS UNDER THEIR SIGNED PATIENT AGREEMENTS OR UNDER THE LAWS GOVERNING THE PRACTICE OF MEDICINE.
15. Indemnification
You agree to indemnify, defend, and hold harmless ClearCardio® LLC and its officers, physicians, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees and costs — arising out of or related to: (a) your violation of these Terms; (b) your misuse of the Site or its Content; (c) material you submit to us or post through the Site; or (d) your violation of any law or of any third party's rights in connection with your use of the Site. This obligation does not apply to claims arising from clinical care, which are governed by your patient agreement and applicable law.
16. Suspension and termination
We may suspend, restrict, or terminate your access to the Site (or any feature of it) at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Site, our patients, or our staff. You may stop using the Site at any time. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — survive any termination of these Terms. Termination of website access does not by itself affect any existing clinical relationship, which is governed by your patient agreement.
Force majeure. We are not responsible for any delay or failure in the Site's availability or in our website-related obligations caused by events beyond our reasonable control, including natural disasters, power or telecommunications failures, hosting-provider outages, cyberattacks, labor disputes, epidemics, or acts of government.
17. Governing law and venue
These Terms, and any dispute arising out of or relating to them or your use of the Site, are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to Section 18, any legal action arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Denton County, Texas, and you consent to the personal jurisdiction and venue of those courts.
18. Dispute resolution
We believe most disagreements can be resolved directly. Before filing any legal action arising out of these Terms or your use of the Site, you agree to first contact us at care@clearcardio.com with a written description of the dispute and to negotiate in good faith for at least sixty (60) days toward an informal resolution. Either party may seek temporary injunctive relief during this period where necessary to prevent irreparable harm. If the dispute is not resolved within that period, either party may pursue it in the courts identified in Section 17. Nothing in this section limits any non-waivable right you may have under applicable law.
19. Severability and no waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable — or severed if it cannot be — and the remaining provisions will continue in full force and effect. Our failure or delay in enforcing any right or provision of these Terms is not a waiver of that right or provision; a waiver is effective only if in writing and signed by ClearCardio.
20. Entire agreement
These Terms, together with our Privacy Policy and HIPAA Notice of Privacy Practices (each to the extent applicable), constitute the entire agreement between you and ClearCardio regarding your use of the Site, and supersede all prior or contemporaneous understandings regarding the Site. They do not supersede, amend, or replace any signed patient agreement, informed consent, or other clinical document, each of which remains a separate agreement governing its own subject matter. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, merger, or sale of the practice.
21. Changes to these terms
We may revise these Terms from time to time. The current version, with its effective date, will always be posted on this page. Material changes take effect when posted (or on a later date the update states), and your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to a revision, your remedy is to stop using the Site. Effective date of this version: July 22, 2026.
